      法院在审理公立大学录取纠纷案件时,如果仅适用单一审查标准,在特定情形中可能无法充分救 济学生权利。美国法院认可录取行为属于大学自治与学术自由范畴,但对其行使裁量权做出的评判结论并 非一概遵从。在实务中,法院亦基于行政法和宪法条款构造了由宽松至严苛的审查标准,根据不同案情解 决录取评价中出现的程序纠纷和分类纠纷,合理配置举证责任。我国法院有必要根据诉讼主张和案情事 实,适当提高司法审查强度,关注录取评价的实体性正当程序,甚至适度审视形成评判结论的逻辑过程,以 法律监督切实保障录取工作的公平正义。
英文摘要
      When court reviews admission disputes concerning public universities and applies one single judicial review standard, student’s violated right might not be fully remedied in specific situation. In the United States, court recognizes that admission is part of university autonomy and academic freedom, but refuses to give complete deference to judgement concluded with discretion. Based on clauses in administrative laws and the Constitution, court constructs judicial review standards from being deferential to stringent. Standards are applied in different cases to solve disputes about process and classification raised in admission evaluation, which reasonably allocates burden of proof. It is necessary for Chinese court to heighten judicial review standards, according to claims and circumstances in different cases. On this occasion, to insure equity and justice of admission, court is supposed to give more attention to substantive due process in admission evaluation and moderately review logic process in concluding that judgement
