The "Civil Code" stipulates the obligations of preventing and controlling sexual harassment of universities to strengthen the regulation of sexual harassment on campus. However, at present, universities have problems treating sexual harassment prevention and controlling according to teachers’ ethics codes, which makes universities face the legal risk of not fulfilling their obligations. The relevant duty of universities includes the establishment of prevention and controlling system, and the rationality of the preventing and controlling measures. The former includes agencies and personnel setting, special regulations, publicity of laws and policies, etc. The latter is mainly judged from sexual harassment identification standards, sexual harassment handling results judgment standards, application of cross-examination investigation methods, and handling of the relationship between school investigations and criminal investigations. etc. For better performance of the obligations, universities should pay attention to information confidentiality and victim protection in the process of preventing and controlling of sexual harassment. |
